Family Law Proceedings in California

The proper venue for filing requests and seeking judgments on family-related legal issues is the Family Law Division of the California Superior Court. Some of the family issues addressed here include ending a marriage or domestic partnership, establishing or modifying child custody and visitation, ordering support for children and spouses. Additionally, the Family Law Court handles paternity and adoption matters.

 

When planning to proceed with your own family law case, you should first establish which legal process is appropriate for your situation. The most common family law filings include:

  • Legally ending a Marriage or Domestic Partnership

    • Divorce (Dissolution)

    • Legal Separation

    • Annulment of Marriage

 

It is best if you and your spouse or partner proceed with the matter as uncontested in the above-noted proceedings. Reaching an agreement on all issues makes for a less expensive, less stressful, and more expedited process.

When determining how to proceed, you may want to consider a Summary Dissolution. The court has established specific qualifying requirements that everyone must meet before proceeding.

 

 

Other matters litigated in the Family Court include Child Custody/Visitation and Child/Spousal Support. These matters are frequently addressed as part of the divorce process. However, they may be handled separately when a divorce proceeding is not an issue before the court or when one party seeks to modify an existing court order.
