Eviction Proceedings in California
If you plan to begin an eviction process against your tenant, you must understand California laws and how they apply to your specific set of circumstances.
To begin the process, a "Legal Notice" must be given to your tenant. California statutes identify the method in which service must be completed. Additionally, all terms to which the tenant must comply must be communicated within the Legal Notice.
Legal Notices commonly range from a 3-day Pay or Quit to a 60-day Notice to Vacate the Premises. However, certain circumstances may exist to eliminate your legal requirement to serve your tenant with a legal notice.
Once the period of time identified in your Notice to the tenant has elapsed, your tenant must be in full compliance. If your tenant has not complied, your court eviction process should be initiated. However, it's important you understand court proceedings may not be started early; doing so will force the court to dismiss your case.
